1. Acceptance of Terms

Welcome to Protokl. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Protokl (“we,” “our,” or “us”) regarding your use of the Protokl mobile application and related services.

By downloading, installing, accessing, or using Protokl, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the app.

Your use of the App is also subject to Apple's Standard Licensed Application End User License Agreement (EULA), available at apple.com/legal.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years of age to use Protokl. If you are between 13 and 18 years old, you must have parental or guardian consent to use the app.

2.2 Capacity to Agree

By using the app, you represent and warrant that you have the legal capacity to enter into these Terms and that you are not prohibited from using the app under applicable laws.

3. Health and Medical Disclaimer

3.1 Not Medical Advice

IMPORTANT: Protokl is a fitness tracking and wellness tool and is NOT a medical device, medical service, or substitute for professional medical advice, diagnosis, or treatment.

  • Does not provide medical advice or diagnosis
  • Is not intended to treat, cure, or prevent any disease or medical condition
  • Should not replace consultation with qualified healthcare professionals
  • Is designed for general fitness and wellness tracking purposes only

3.2 Consult Healthcare Professionals

You should always consult with a physician or qualified healthcare provider before starting any fitness program, changing your diet, or making any decisions based on information provided by the app.

3.3 Use at Your Own Risk

You acknowledge and agree that you use Protokl and participate in any fitness activities entirely at your own risk. We are not responsible for any injury, illness, death, or any adverse health effects resulting from your use of the app.

3.4 No Guarantee of Results

Protokl provides projections, forecasts, and estimates based on physiological research and algorithms. These are estimates only. We make no guarantees regarding weight loss, muscle gain, body composition changes, or any other fitness outcome.

3.5 Nutritional Information

Nutritional information and meal recommendations provided by Protokl are for general informational purposes only. Users with food allergies, intolerances, or medical dietary restrictions should consult a registered dietitian or physician.

3.6 HealthKit Data Accuracy

Protokl displays data synced from Apple HealthKit and other sources. We do not guarantee the accuracy, completeness, or reliability of data from third-party devices, sensors, or platforms.

4. User Responsibilities

4.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, and notifying us immediately of any unauthorized access or security breach.

4.2 Acceptable Use

You agree to use Protokl only for lawful purposes and in accordance with these Terms.

4.3 Content You Provide

You are solely responsible for the accuracy of information you enter, photos and content you upload, and ensuring you have rights to any content you share.

4.4 Physical Fitness

You represent that you are in adequate physical condition to engage in the fitness activities you track with Protokl, and that you have obtained any necessary medical clearances before beginning a fitness program.

5. Intellectual Property Rights

Protokl and all its content, features, functionality, algorithms, and forecasting models are owned by us or our licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the app for your personal, non-commercial fitness tracking purposes.

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7. Subscription Services

7.1 Subscription Plans

Protokl offers auto-renewable subscription plans that provide access to premium features. Subscription pricing and features are clearly displayed within the app before purchase.

7.2 Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.

7.3 Managing Your Subscription

You can manage your subscription and turn off auto-renewal at any time by going to your Account Settings in the App Store.

7.4 Free Trial

Protokl may offer a free trial period for new subscribers. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

7.5 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of the current billing period. Refunds are subject to Apple's App Store refund policies.

7.6 Price Changes

We reserve the right to change subscription pricing. You will be notified in advance of any price changes.

8. Third-Party Services

Protokl integrates with third-party services including Apple HealthKit and RevenueCat. Your use of these integrations is subject to the terms and privacy policies of those platforms.

9. Disclaimer of Warranties

Protokl is provided “as is” and “as available” without warranties of any kind, either express or implied.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Protokl, its owner, affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

Our total aggregate liability to you for all claims shall not exceed the greater of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100 USD).

11. Assumption of Risk

You expressly acknowledge and agree that any physical exercise, dietary changes, or health-related activities you undertake in connection with your use of Protokl are done at your sole risk.

12. Indemnification

You agree to indemnify, defend, and hold harmless Protokl, its owner, officers, employees, agents, and affiliates from and against any and all claims arising from your use of the app.

13. Account Termination

You may stop using the app at any time by deleting it from your device. We reserve the right to suspend or terminate your access for violation of these Terms.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at protoklapp@gmail.com and attempt to resolve the dispute informally for at least 30 days.

14.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada.

14.3 Class Action Waiver

You agree that any claims shall be brought only in your individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

14.4 Jurisdiction

Any legal action arising from these Terms must be brought in the courts located in the Province of Alberta, Canada.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary.

16. Entire Agreement

These Terms, together with the Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and Protokl.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the app after changes constitutes acceptance of the modified Terms.
